Change of the schedule of works for the construction of the Szczecin-Gdańsk gas pipeline

In reference to the current report 11/2014 of 15 May 2014 concerning the Agreement of 10 May 2012, signed between a consortium of companies (Contractor) composed of ZRUG Zabrze SA as leader of a consortium of companies and Stalprofil SA with its registered office in Dąbrowa Górnicza(consortium member) and Gas Transmission Operator Gaz-System SA with its registered seat in Warsaw (Employer) for general investments under the name "construction of the pipeline DN 700 Szczecin- Gdańsk: Phase II Karlino Koszalin, Koszalin Stage III - Slupsk and Stage IV Slupsk Wiczlino, the Board Stalprofil SA informs that due to non-completion of works by the Contractor (for reasons beyond the control of the Contractor), established on 30th September 2014 partial acceptance of Phase II and Phase III have not been made. According to the current timetable of the Contractor, showing the actual progress of the work, the term of partial acceptance for Phase II and III will take place until 22 December 2014.
ZRUG Zabrze SA submitted a request to the Employer to change the deadlines for partial acceptances of Stage II and Stage III, while the extension of the investment (ie. deadline for final acceptance) until 22 December 2014 inclusive, justifying it ascribable to the Employer, in particular:
- suspension of works by the Employer not resulting from circumstances for which the guilt borne by the Contractor,
- the need to correct errors or make changes in the design documentation.
The Employer confirmed the proposed term partial acceptances of Phase II and III, speaking at the same time to the Contractor for extension of the validity of the performance guarantee and warranty (see current report 18/2014). According to the annex of May 15, 2014 the deadline of final acceptance is now determined until 14 November 2014 inclusive.
