Learning from the company TESGAS S.A. not to renew the validity of the deposit as collateral of a bid for "Construction of the pipeline DN700 Hermanowice-Strachocina"

In reference to the current report 30/2016 The Management of STALPROFIL S.A. informs that on 28 December 2016, the Company received from the company TESGAS S.A. (Consortium Leader) letter informing about the non-renewal by the Consortium Leader validity of the deposit as collateral for the bid submitted by the consortium of companies comprising 1) TESGAS S.A., 2) IZOSTAL S.A., 3) STALPROFIL S.A. (the company became a member of the Consortium in the way of universal succession - the incorporation of a subsidiary ZRUG Zabrze S.A.), 4) Friedrich VORWERK KG (GmbH&Co), in the tender organized by OGP GAZ-SYSTEM S.A. with its seat in Warsaw (the Purchaser) on the "Implementation of works for the investment task "construction of the pipeline DN700 Hermanowice-Strachocina"".

In connection with the discontinuation of validity of the deposit of the Consortium Leader, from the date of 28 December 2016 offer of the consortium is not secured by a deposit, whereby in accordance with art. 24 par. 2 item 2 of the Public Procurement Law (CAP), as in force on the day of the procedure for the award of a public contract, the contractor whose tender is not secured by the deposit is excluded and, consequently, in accordance with art. 24 par. 4 PZP offer of the contractor shall be rejected.
